These Terms of Service (“Terms”) govern your access to and use of the website located at controlapproach.com (the “Site”), and any products, content, or services offered through it (collectively, the “Services”), operated by EfficientApproach, doing business as ControlApproach™ (“ControlApproach,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Site or Services.
If you are using the Site on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Site or purchase products from us. By using the Site, you represent and warrant that you meet these requirements.
3. Products and Aviation Use Disclaimer
3.1 Nature of Products. ControlApproach designs, manufactures, and sells rudder pedal systems and related control assemblies for use in Van’s RV-series experimental/amateur-built aircraft kits, including but not limited to the RV-6, RV-7, RV-9, RV-10, RV-14, and RV-14A, as well as stock replacement pedal components (the “Products”).
3.2 Experimental Aircraft — Buyer Responsibility. Our Products are intended for installation in experimental, amateur-built aircraft assembled and maintained under applicable Federal Aviation Administration (FAA) or other relevant national aviation authority regulations. Our Products are not FAA-certified parts, and no representation is made that they meet any specific certification standard. It is the sole responsibility of the purchaser, builder, installer, and/or aircraft owner to:
3.3 No Flight-Readiness Warranty. ControlApproach makes no warranty, express or implied, that any Product is fit for flight in any particular aircraft or under any particular condition. Aviation involves inherent risk, and improper installation, maintenance, or use of any component — including our Products — may result in serious injury or death. You assume all risk associated with the purchase, installation, and use of our Products.
3.4 Product Descriptions. We attempt to describe and display our Products, including dimensions, materials, and compatibility, as accurately as possible. We do not warrant that product descriptions, images, or other content on the Site are accurate, complete, current, or error-free.
4. Orders, Pricing, and Payment
4.1 Order Acceptance. All orders placed through the Site are subject to acceptance by ControlApproach. We reserve the right to refuse or cancel any order for any reason, including suspected fraud, pricing errors, or product unavailability, whether or not the order has been confirmed or payment processed.
4.2 Pricing. Prices for Products are listed on the Site and are subject to change without notice. We make reasonable efforts to ensure pricing accuracy but are not liable for typographical or pricing errors, and we reserve the right to correct any such errors and to cancel any orders placed based on an incorrect price.
4.3 Payment. Payment must be made in full at the time of order through the payment methods made available on the Site. You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided.
4.4 Taxes and Duties. You are responsible for any applicable sales tax, use tax, customs duties, or import fees associated with your order, except where we are legally required to collect such amounts.

Title and risk of loss for Products pass to you upon delivery to the shipping carrier, unless otherwise required by law. ControlApproach is not responsible for delays caused by carriers, customs, or other events outside our reasonable control.
6. Returns, Cancellations, and Warranty
6.1 Returns. Because many Products are manufactured or configured to specific aircraft models, please review product listings carefully before ordering. Any return, exchange, or cancellation requests are subject to review and approval by ControlApproach and may be subject to a restocking fee or be ineligible for return if custom-manufactured. Contact us prior to returning any item.
6.2 Limited Warranty. Except as otherwise expressly stated at the time of sale, Products are sold “as is.” Any limited warranty covering defects in materials or workmanship applies only to the original purchaser and does not cover damage resulting from improper installation, modification, misuse, normal wear and tear, or use inconsistent with the manufacturer’s instructions.
6.3 Disclaimer of Other Warranties. Except for any express warranty stated in writing at the time of sale, ControlApproach disclaims all other warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the extent any liability is found notwithstanding the foregoing, ControlApproach’s total aggregate liability for any claim arising out of or relating to these Terms or any Product shall not exceed the amount you paid for the Product giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless ControlApproach, EfficientApproach, and their respective owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your use of the Site or Products; (b) your installation, maintenance, or use of any Product in an aircraft; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party right.
12. Assumption of Risk
You acknowledge that aviation, aircraft construction, and aircraft component installation involve inherent risks, including the risk of serious injury or death. You voluntarily assume all such risks associated with the purchase, installation, and use of any Product purchased from ControlApproach.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Oregon, and you consent to personal jurisdiction and venue in those courts.
